City of Eastland Notice to Political Candidates

With March primaries approaching, political signs are starting to appear within the city. Here are the city and state rules for displaying political signs:

The City of Eastland Ordinance reads in part:

OFF PREMISE SIGNS ARE:  Non-compliance placed signs that may include, but not limited to, political, garage sale, real estate and other types of signs. All of these signs, if placed upon rocks, trees, boxes, bridges, fences, windmill towers, utility poles and or dilapidated buildings within a city easement or state rights-of-way, are in violation of city and state ordinances.

OFF PREMISE SIGN ENFORCEMENT:  City of Eastland Zoning Ordinance PROHIBITS Off Premise Signs located within the City of Eastland and all signs in public street rights-of-way, public easements, alleys, or upon any utility pole.

A public right-of-way includes the area that extends from the property line to the curb or street. The average right-of-way is 15 feet from the curb or for those without curbs, 20 feet from the edge of the street to the property line. Signs placed behind the sidewalk, on private property, are allowed.

 Signs may only be placed, on private property , and not at the curb or on easement or rights of way, and ONLY with the property owner’s permission. NO BOX SIGNS. Signs MUST be removed immediately, and not later than 24 hours following the end of the sale or event.

STATE ELECTION CODE, Section 255.007: political signs are required to have the following notice placed on the sign: “NOTICE: IT IS A VIOLATION OF STATE LAW (CHAPTERS 392 & 393, TRANSPORTATION CODE), TO PLACE THIS SIGN IN THE RIGHT OF WAY OF A HIGHWAY.”

Candidates are responsible for complying with both City Ordinance and state election code regulating placement of political signs.
